This Acceptable Use Policy (Policy) governs how users may access and use the Tap Ease website, platforms, EFTPOS terminals and related services.

This Policy forms part of, and is incorporated into, the Tap Ease Website Terms & Conditions. Capitalised terms have the meanings given in those Terms.

1. Purpose and Scope

1.1 This Policy is designed to protect Tap Ease, users, financial institutions and regulators from fraud, misuse, regulatory breach and operational risk.

1.2 Compliance with this Policy is a strict condition of access to and use of the Services.

2. Permitted Use

2.1 You may use Tap Ease services solely: (a) for lawful transactions arising from genuine services personally provided by you; and (b) in accordance with the Website Terms & Conditions and all Associated Policies.

2.2 You must ensure that all transaction amounts entered are accurate and reflect the agreed price for the service provided.

3. Prohibited Conduct

You must not, whether directly or indirectly: (a) use a Terminal for non-genuine, fictitious or misleading transactions; (b) process payments for another person, driver, business or entity without written approval; (c) use the Services to transfer, circulate or move funds between individuals; (d) split transactions to avoid limits, monitoring or controls; (e) process payments unrelated to lawful transport or approved services; (f) permit unauthorised third parties to access or use a Terminal or Account; (g) submit false, misleading or incomplete information; (h) engage in conduct that is fraudulent, deceptive or misleading; (i) interfere with, reverse engineer or tamper with systems or devices; (j) use the Services for any unlawful purpose; (k) attempt to conceal, disguise or misrepresent the nature of transactions.

4. Monitoring and Audit Rights

4.1 Tap Ease may monitor transactions, usage patterns and activity for risk, compliance and security purposes.

4.2 You consent to Tap Ease: (a) requesting explanations, records or documentation; (b) auditing usage and transaction history; (c) contacting banks, processors, operators or authorities where required.

5. Suspension, Restriction and Termination

5.1 Tap Ease may, at its absolute discretion and without notice: (a) suspend or terminate access to the Services; (b) restrict transaction processing; (c) delay or withhold settlements; (d) require additional verification or documentation; (e) report activity to financial institutions, regulators or law enforcement.

5.2 Action may be taken where Tap Ease identifies suspected misuse, risk, non-compliance, regulatory concern or breach of this Policy.

5.3 Tap Ease is not liable for any loss suffered as a result of actions taken in good faith under this Policy.

6. No Trust, Agency or Fiduciary Relationship

6.1 Nothing in this Policy creates a trust, agency, partnership or fiduciary relationship.

6.2 Funds processed through third-party payment systems are not held by Tap Ease on trust for users.

7. Indemnity

You indemnify Tap Ease against all loss, damage, penalties, claims and expenses arising from your breach of this Policy or misuse of the Services.

8. Amendments

Tap Ease may amend this Policy at any time by publishing an updated version on its website. Continued use constitutes acceptance.

Use of Tap Ease services constitutes acceptance of this Policy.
